TERMS OF USE

1. This legal notice applies to the entire contents of the PM Group Equity Gateway. Any rights not expressly granted in these terms are reserved by PM Group.

2. Global Shares Ireland Limited (trading as “Global Shares”) administers the Share Scheme (“the Plan”) on behalf of PM Group.  For further information on Global Shares role as a company share plan administrator, please visit www.globalshares.com

2. DATA PROTECTION & COPYRIGHT

2.1 Unless otherwise stated, the copyright and other intellectual property rights in all material on PM Group Equity Gateway the (including without limitation photographs and graphical images) are owned by PM Group or its licensors including Global Shares. For the purposes of this legal notice, any use of extracts from the PM Group Equity Gateway other than in accordance with clause 2.1 for any purpose is prohibited. If you breach any of the terms in this legal notice, your permission to use the PM Group Equity Gateway automatically terminates and you must immediately destroy any downloaded or printed extracts from the Website.  
2.2 Subject to clause 2.1, no part of the PM Group Equity Gateway may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without PM Group's prior written permission.  
2.3 We may collect information about your computer, including, where available, your operating system and browser type for system administration and to report aggregate information for statistical analysis to help us improve our services.  This is statistical data about our user’s browsing actions and patterns and does not identify any individual.   We may obtain information about your general internet usage by using a cookie file which is stored on your browser or the hard drive of your computer.  If you use our site, you agree to our use of cookies.
2.4 On occasion, you will be asked to submit personal information and data about yourself (e.g name, address etc) for the purpose of implementing, administration and management of the Plan and in order to receive services via the PM Group Equity Gateway.  By entering your details in the field requested, you enable PM Group to provide you with your requested services. Any information you provide will not be supplied to anyone outside PM Group and Global Shares without first obtaining your consent, unless we are obliged or permitted by law to disclose it.  Any such information shall be held on our systems for as long as the purpose requires it.  We will ensure that all personal information is held securely in accordance with relevant data protection legislation.  To enquire about accessing your personal data or if you have any questions relating to PM Group’s data protection and privacy policy, please contact the HR Department at PM Group, Killakee House, Belgard Square, Dublin 24, Ireland.  

3. LICENCE 

3.1 You are permitted to print and download extracts from the PM Group Equity Gateway on the following basis: 
(a) no documents or related graphics on the PM Group Equity Gateway are modified in any way;
(b) no graphics on the PM Group Equity Gateway are used separately from the corresponding text; 
(c) use of such extracts is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media; and
(d)  The copyright and trade mark notices of PM Group and Global Shares and this permission notice appear in all copies. 

4. SERVICE ACCESS 

4.1 Access to the PM Group Equity Gateway may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond PM Group's control.

5. YOUR ACCOUNT & PASSWORD

Your username and password are part of our security procedures and must be treated as confidential.  You must not disclose it to any third party. We have the right to disable any username and password if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

6. ACCESSING PM GROUP EQUITY GATEWAY FROM NON-PM GROUP HARDWARE

The PM Group of companies, any the officers, directors, employees of any of them exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages arising from or connected in any way to business interruption (whether in tort, negligence, contract or otherwise) in connection with the PM Group Equity Gateway including but not limited to loss or damage due to viruses that may infect your personal computer equipment, software or data.  If your use of material on the PM Group Equity Gateway results in the need for servicing, repair or correction of such equipment, software or data, you assume all costs thereof.

7. DISCLAIMER

7.1 While PM Group endeavours to ensure that the information on the PM Group Equity Gateway is correct, PM Group does not warrant the accuracy and completeness of the material on the PM Group Equity Gateway.  PM Group may make changes to the material on the PM Group Equity Gateway at any time without notice. The material on the PM Group Equity Gateway may be out of date, and PM Group makes no commitment to update such material. The material on the PM Group Equity Gateway is provided "as is", without any conditions, warranties or other terms of any kind.

8. GOVERNING LAW AND JURISDICTION

The Irish courts will have exclusive jurisdiction over any claim arising from or related to, a visit to the PM Group Equity Gateway although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.  These terms of use and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed with the laws of Ireland.
